Request for Investigation: DJJ violations of Florida grant review procedures- 2008-9.

The Department of Juvenile Justice 2008-9 grant application and review process excludes the juvenile justice circuit boards and juvenile justice county councils from their statutory role to "advise and assist the department in the evaluation and award of prevention and early intervention grant programs." [Florida statutes 985.664 and 985.767] The statute provides that the juvenile justice boards and councils review grant applications. Instead, the department will provide "concept papers" for review. In other words, the boards and councils review one thing and the department acts on another.

I have forwarded a copy of my message to DJJ Grants Manager Maury Kolchakian, dated 11/08/07 in which I express my complaint (below). Also attached is a copy of DJJ's "Delinquency Prevention Concept Paper Instructions and Forms Fiscal Year 2008-2009." [Grant_Concept_Paper_08- 09.doc] I based my complaint on this document. Mr. Kolchakian:

I note that you delayed your response to my third request for training date and details until after training had ended. [E-mail 11/07/07]. Your failure to provide a timely response is a minor issue in a bigger problem: DJJ's 2008-9 grant review process continues to violate Florida statute.

In your 2008-9 prevention grant application process, DJJ's timeline excludes the juvenile justice circuit boards and juvenile justice county councils from review of grant applications. This violates Florida statute 985.676 "Community juvenile justice partnership grants." The law makes clear the Grant Application Procedures in subsection (2):

985.676 (2) (a): Each entity wishing to apply for an annual community juvenile justice partnership grant… shall submit a grant proposal for funding…In order to be considered for funding, the grant proposal shall include the following assurances and information: 1. A letter from the chair of the juvenile justice circuit board confirming that the grant application has been reviewed and found to support one or more purposes or goals of the juvenile justice plan as developed by the board.

985.676 (2) (b): The department shall consider the following in awarding such grants: 1. The recommendations of the juvenile justice county council as to the priority that should be given to proposals submitted by entities within a county.

The role of the boards and councils in the grant review process is reinforced in s. 985.664 "Juvenile justice circuit boards and juvenile justice county councils." Subsection (5) requires that "juvenile justice circuit boards and county councils shall advise and assist the department in the evaluation and award of prevention and early intervention grant programs including the Community Juvenile Justice Partnership Grant program established in s. 985.676…"

The department's Prevention Grant Application Process and Timeline has just three entries referencing circuit boards and county councils: [*]

November 2-9, 2007 Training conducted for Juvenile Justice Circuit Board and County Council Grant Review Committees.
December 7, 2007 Concept Papers provided to Juvenile Justice Circuit Board and County Council Grant Review Committees for review, scoring and recommendations in priority order.
January 18, 2008 Recommendations of Concept Papers due from Juvenile Justice Circuit Boards are due by 5pm EST to the Office of Prevention & Victim Services, Tallahassee, Florida.
This review by the boards and councils deals with "concept papers." The department defines concept papers as "an extremely important part of the application process because they enable DJJ to learn the program areas of primary interest to potential applicants and to explore innovative ideas without imposing heavy burdens on prospective applicants. The use of concept papers also permits us to better project the nature and amount of grant awards." [] Concept papers are not grant applications.

Returning to the timeline, the first mention of grant applications is

January 31, 2008 Notification to selected Concept Paper Applicants. Disseminate Grant Applications and Terms and Conditions.
The timeline moves on:

March 7, 2008 Final Grant Application due…
March 31, 2008 Review by Department of Juvenile Justice General Counsel…
May 1, 2008 Grant Award/Agreement letters mailed.
Nowhere in the timeline do the boards and councils review grant applications as required by state law.

Please revise your grant application review procedure to comply with Florida statute.
Include in your procedure a grant review committee training schedule that provides several weeks notice so that the committee members can plan to participate.

Charlie,

On May 1, 2009, one year will have passed since I requested an investigation into the Department of Juvenile Justice’s violations of Florida statutes concerning the Department’s 2008-9 grant application and review process. I have yet to receive a status of the case other than it is “still active.”

Therefore, I am asking for your help to bring this issue to a close. Here is the chronology of my request for an investigation:

May 1, 2008—I e-mailed my complaint to Investigations Manager Heidi Huelskotter of the Office of the Chief Inspector General.

May 2, 2008—OIG Investigations Manager Huelskotter replied by e-mail to say that my complaint was assigned Chief Inspector General Case #200805010001 and referred to the Inspector General for the Department of Juvenile Justice for “review and action deemed appropriate.”

June 23, 2008—I e-mailed Inspector General Mary Eubanks of the Department of Juvenile Justice asking for confirmation of receipt of Huelskotter’s referral, DJJ’s case number for my complaint, and the status of the Department’s investigation.

June 23, 2008—Eubanks e-mailed that my complaint had been assigned OIG Case # 08-0117 and that the status of the investigation was “ongoing.”

September 4, 2008—I e-mailed Eubanks asking for the status of OIG Case # 08-0117. I received no reply.

November 17, 2008—I e-mailed Eubanks again asking for the status of OIG Case # 08-0117. I received no reply.

December 8, 2008—I e-mailed Eubanks again for the status and, again, I received no reply.

January 5, 2009—I e-mailed Eubanks for the fourth time asking for the status of OIG Case # 08-0117.

January 5, 2009—The Department’s Chief of Investigations Howard Greenfield replied by e-mail, on behalf of Eubanks, that the case was “still active” and that they would “work as diligently as possible to conclude this matter.”

January 29, 2009—I e-mailed Greenfield for a status of the case. I received no reply.

March 19, 2009—I e-mailed Greenfield, again, for a status of OIG Case # 08-0117. Again, I received no reply.
The e-mail trail of my correspondence with the Department is provided for your information.

It is now mid-April 2009. Rather than spend more of my time asking the Department of Juvenile Justice for a status of their investigation of my complaint (OIG Case # 08-0117), I ask that you approach the Department on my behalf.
